FOI and privacy

AGS's national information practice of more than 25 lawyers and key practitioners has a strong track record in defending freedom of information (FOI) decisions made by agencies before the Australian Information Commissioner and in the Administrative Appeals Tribunal, Federal Court and High Court of Australia. We regularly act in the most high-profile and sensitive FOI and privacy matters, advising on privacy issues and representing agencies before the Information Commissioner in FOI review applications and privacy complaints.

AGS has been at the forefront of developments in FOI, privacy and confidentiality laws since their enactment. We understand acutely the relevance of concepts such as public interest and representative government to our work on these matters.

We have worked closely with clients to help them develop a detailed appreciation of the practical and legal implications of the FOI reforms that commenced on 1 November 2010 and 1 May 2011. We are currently working closely with clients to assist them in developing an understanding of the practical and legal implications of the significant privacy reforms made by the Privacy Amendment (Enhancing Privacy Protection) Act 2012 which commenced on 12 March 2014.

We are available to meet with agencies to discuss the overall effect of these reforms and the impact that the new Australian Privacy Principles (APPs) will have on day-to-day agency operations and to provide detailed advice on these issues. We are also available to review and update agency documents to ensure that they comply with the APPs.

AGS has for many years run a regular FOI Practitioners Forum that is always well-attended and highly regarded by Commonwealth Government FOI officers, keeping our clients informed of the latest developments and enabling them to share their experience across agencies.
