Work in progress – what are we learning?
The last few years have seen plenty of change on the employment and industrial law fronts. Many of these changes have a unique impact on the public sector. We are getting a clearer picture of how developments in policy and law are informing enterprise bargaining, how the Fair Work Commission is approaching its workplace bullying jurisdiction, and how the Public Interest Disclosure Act 2013 is affecting the management of conduct complaints. We are also seeing more change on the horizon, with new adverse action cases clarifying the scope of employee rights, shifting approaches in the Fair Work Commission to employee misconduct and some significant damages awards from the Federal Court in sexual harassment cases.
